Lawyer Argues Client Too Old for Long Prison Term

The advanced age of a West Village man convicted of fatally stabbing his girl friend was the focus of a squabble between defense and prosecution at the defendant’s sentencing on Thursday.

Dennis Guglielmo’s defense attorney, Adam Freedmen, was asking for a 15-year sentencing for the 71-year-old man, arguing, in effect, that a longer sentence would be tantamount to a life term.

“It’s a generous offer,” said Freedman. “If he goes to prison now, he can leave at 86. He’ll be too old for prison.”

The prosecuting attorney disagreed, requesting the usual 25 years to life.

Manhattan Judge Michael Obus reserved his decision for the next day.

Guglielmo was arrested in 2014 for murdering his girlfriend, Alice Birnbaum, in his apartment with a axe and a knife. Freedman claims that he was most likely mentally unstable during the stabbing. Two weeks before the stabbing, Guglielmo checked in at Bellevue Hospital complaining of paranoia and an acute lack of sleep, according to law enforcement sources.
