Prosecution Rests in Bklyn Murder Case

A forensic biologist presented a Brooklyn jury  on Tuesday with alleged evidence of a murder suspect’s DNA found on a handgun and champagne bottle that were retrieved from the scene of the crime in January.

The DNA was alleged to belong to suspect Tyrone Gainer, who is being tried in the fatal shooting of Jason Lewis at the Country House Diner in Clinton Hill.

Expert witness Diana Ho, a forensic biologist with eight years experience with the New York City chief medical examiner, reviewed the DNA evidence for the case. Her lab had received six DNA samples, five from a handgun and one from the rim of a champagne bottle.  All six samples were found to match the DNA of Gainer , she testified.

Ian Harding was also called to the stand. Harding was the victim’s nephew, though he described their relationship to be “more like brothers.” He then testified that he identified the body of Lewis at the city morgue.

The defense declined to cross-examine either witness, and the prosecution rested its case. The trial was scheduled resume Wednesday.
