The man accused of killing his live-in girlfriend in 2011 took the stand in Brooklyn criminal court Tuesday to declare that he acted in self-defense.
“I was just scared for my life,” said Woody Borgella, 33, swearing that he did not intend to kill his Lori Ann Evans in 2011 in their shared Brooklyn apartment. He described Evans standing on the bed and wielding a kitchen knife.
Borgella used a .25 caliber handgun to shoot Evans, a former porn star, in the chest. The medical examiner earlier testified that Evans died when the bullet hit her pulmonary artery. The gun belonged to the former occupant of the room who was living with his mother in New Jersey.
“I went where my legs took me,” Borgella said when explaining running away from the scene.
He maintained his defense saying that the intent was never to shoot Evans but “scare her.”
Submission into evidence of an ominous Facebook post by Borgella citing song lyrics allegedly foretelling Evan’s death was barred by Judge Alan Marrus. Borgella testified that someone else ued his password to file the post. He added that he never “figured out who posted it.”
On the stand, Borgella admitted that he and Evans had a short but tumultuous relationship. They met in June 2011 when Evans was unemployed and homeless; he took her in as a roommate in a three-bedroom apartment at 1506 Ocean Ave that he shared with two childhood friends.
Borgella described her personality as cool, but said she “would flip out on me sometimes.”
Evans led a non-conformist life. Her IMDB page said she was born in Barbados and was an adult film actress performing as Lori Alexander. An adult film site showed that her career lasted from 2005 to 2008. She also performed under the name “Penna Piererra” according to FindAGrave.com.
